BOOKING TERMS & CONDITIONS

1. About AmberFly Travel

AmberFly Travel Ltd is an independent travel agency incorporated in England and Wales under Company Registration Number 13094082 with registered address as 126, Grove Road, Hounslow, London, Middlesex, TW3 3PT

Since our establishment in 2020, we have specialised in providing personalised travel solutions for leisure, family and business travellers, including international flights, hotel accommodation, and tourist visa assistance.

Our aim is to offer competitive prices together with honest advice and exceptional customer service.

Unlike many online booking platforms, every booking is personally reviewed before tickets or travel documents are issued to ensure accuracy wherever possible.


2. Our Role

AmberFly Travel Ltd acts primarily as a travel agent.

We arrange travel services supplied by airlines, hotels, destination management companies, visa processing providers and other travel suppliers.

Unless expressly confirmed otherwise in writing, AmberFly Travel Ltd is not the principal supplier of those travel services.

When arranging travel on your behalf, we act as an intermediary between you and the relevant travel supplier.

Accordingly, your booking may also be subject to the booking conditions, fare rules and conditions of carriage imposed by the relevant supplier.

Copies of applicable supplier terms are available upon request.


3. Financial Protection

AmberFly Travel Ltd is not an ATOL holder, ABTA member or IATA accredited travel agent.

Where your booking qualifies for financial protection under the Air Travel Organiser's Licence (ATOL) Scheme, AmberFly Travel Ltd acts as an authorised travel agent for an ATOL holder.

In such cases:

  • the relevant ATOL holder will provide the financial protection applicable to your booking;
  • an ATOL Certificate will be issued where required under the ATOL Scheme;
  • the ATOL Certificate will identify the ATOL holder responsible for providing your financial protection together with details of the protection applicable to your booking.

The ATOL Certificate is an important document and should be retained with your travel documents.

Where a booking does not qualify for ATOL protection, the financial protection arrangements applicable to that booking will depend upon the supplier providing the travel service.


4. Acceptance of these Booking Terms

These Booking Terms & Conditions apply to every booking made with AmberFly Travel Ltd unless otherwise agreed in writing.

The person making the booking confirms that:

a) they are at least 18 years of age;

b) they have authority to accept these Booking Terms & Conditions on behalf of every traveller included within the booking;

c) all information provided during the booking process is complete and accurate;

d) all travellers agree to comply with these Booking Terms & Conditions.


5. Booking Enquiries and Quotations

5.1

AmberFly Travel Ltd provides travel quotations based on the information supplied by you at the time of enquiry.

5.2

Quotations may be provided by telephone, email, WhatsApp, social media, our website or any other communication method used by AmberFly Travel Ltd.

5.3

Unless specifically stated otherwise in writing, all quotations are subject to:

a) availability;

b) supplier confirmation;

c) airline seat availability;

d) hotel availability;

e) applicable taxes;

f) exchange rate fluctuations;

g) airline or supplier fare changes.

5.4

A quotation does not constitute a confirmed booking and does not create a contractual relationship between you and AmberFly Travel Ltd.

5.5

Prices quoted are normally valid only at the time they are provided. Airlines and travel suppliers use dynamic pricing systems, meaning prices may increase or decrease without notice until tickets or travel arrangements have been confirmed and issued.

5.6

AmberFly Travel Ltd cannot guarantee that any quoted fare, hotel rate or travel arrangement will remain available until full payment has been received and the booking has been confirmed.

 

6. Booking Confirmation

6.1 A booking is considered confirmed only when all of the following conditions have been satisfied:

a) we have received the required payment;

b) your booking has been accepted by the relevant supplier(s);

c) travel documents or a booking confirmation have been issued.

6.2 Until these conditions have been met, AmberFly Travel Ltd reserves the right to withdraw or amend any quotation.

6.3 Once your booking has been confirmed, a confirmation email containing your itinerary and booking details will be sent to the email address provided during the booking process.

6.4 It is your responsibility to review your booking confirmation immediately upon receipt.

6.5 You must notify us immediately if you discover any error relating to:

• passenger names;

• dates of birth;

• travel dates;

• destinations;

• airline sectors;

• passport details (where applicable);

• hotel arrangements; or

• any other booking information.

6.6 Failure to notify us promptly may result in amendment charges imposed by airlines or suppliers, for which you will remain responsible.


7. Accuracy of Passenger Information

7.1 Passenger names must exactly match the names shown in the relevant passport.

7.2 AmberFly Travel Ltd accepts no responsibility for costs resulting from incorrect information supplied by the customer.

7.3 Most airlines charge significant amendment fees for correcting passenger names after ticket issuance. Certain airlines may refuse any name changes altogether.

7.4 You are responsible for ensuring that all passenger details supplied to us are complete and accurate before ticket issuance.


8. Prices

8.1 All prices quoted by AmberFly Travel Ltd are subject to availability at the time of booking.

8.2 Airline fares are dynamic and may change several times during the same day.

8.3 Although we make every effort to honour quoted prices, occasionally airlines or suppliers may increase fares or taxes before tickets have been issued.

8.4 Where a fare or supplier cost increases before ticket issuance, we will inform you as soon as reasonably practicable.

8.5 If you do not wish to proceed at the revised price, you may cancel your booking before tickets are issued and receive a full refund of any payment already made to AmberFly Travel Ltd in respect of that booking.

8.6 Once airline tickets have been issued or travel services have been confirmed, prices cannot be reduced to reflect any later promotional offers or fare reductions.

 

9. Service Charges and Mark-up

9.1 AmberFly Travel Ltd may include a service margin or commercial mark-up within the total price quoted to customers.

9.2 This forms part of our remuneration for arranging your travel services and providing booking support.

9.3 Unless specifically stated otherwise, all prices quoted by AmberFly Travel Ltd are inclusive of our service charges.

9.4 Our service charges are separate from airline fares, taxes and supplier charges and may not be refundable following cancellation, except where required by law.


10. Payments

10.1 Payment may be made using the payment methods accepted by AmberFly Travel Ltd at the time of booking.

10.2 For most bookings departing within eight (8) weeks of travel, full payment is required at the time of booking.

10.3 Where a deposit is accepted, the remaining balance must be paid by the due date specified on your booking confirmation.

10.4 Failure to pay the outstanding balance by the due date may result in:

a) cancellation of your booking;

b) cancellation by the supplier;

c) forfeiture of any deposit paid;

d) additional cancellation charges imposed by suppliers.

10.5 AmberFly Travel Ltd reserves the right to refuse or cancel any booking where payment has not been received in cleared funds

11. Payment Security

11.1 AmberFly Travel Ltd takes reasonable steps to ensure that payments made by customers are processed securely.

11.2 Payments may be processed through secure third-party payment providers approved by AmberFly Travel Ltd.

11.3 We do not store customers' full payment card details unless expressly permitted by applicable law and payment industry requirements.

11.4 Customers are responsible for ensuring that payment details supplied are accurate and that sufficient funds are available.

11.5 AmberFly Travel Ltd reserves the right to decline any payment where fraud or unauthorised activity is reasonably suspected.


12. Currency Fluctuations

12.1 Some travel services are purchased in foreign currencies.

12.2 Exchange rate movements may affect the final price payable before your booking has been confirmed.

12.3 Where exchange rate movements significantly affect supplier costs before confirmation, AmberFly Travel Ltd reserves the right to amend the quoted price accordingly.

12.4 Once full payment has been received and your booking has been confirmed, exchange rate fluctuations will not affect the agreed booking price unless otherwise permitted under these Booking Terms & Conditions or by applicable law.


13. Your Responsibilities During the Booking Process

13.1 You are responsible for:

a) providing complete and accurate information;

b) ensuring that all passenger names exactly match the relevant passports;

c) checking all quotations, confirmations and travel documents immediately upon receipt;

d) notifying AmberFly Travel Ltd immediately of any errors or omissions;

e) ensuring that all travellers hold valid passports, visas and any other required travel documentation;

f) complying with all health, vaccination and entry requirements applicable to your destination;

g) making all payments by the due dates specified;

h) complying with these Booking Terms & Conditions and any additional conditions imposed by the relevant travel supplier.

13.2 AmberFly Travel Ltd accepts no responsibility for losses, delays, additional costs or disruption arising from inaccurate information supplied by the customer or failure to comply with the above responsibilities.

14. Our Travel Services

14.1 AmberFly Travel Ltd provides a range of travel-related services including, but not limited to:

a) Scheduled international and domestic flight bookings;

b) Hotel and accommodation reservations;

c) Airport transfers and selected ground arrangements;

d) Visitor, tourist and business visa assistance services;

14.2 The services available for booking may vary depending upon destination, supplier availability and applicable regulations.

14.3 All travel services are subject to availability and acceptance by the relevant supplier.


15. Flight-Only Bookings

15.1 AmberFly Travel Ltd specialises in arranging flight-only bookings with scheduled airlines operating worldwide.

15.2 Flight bookings are made subject to the airline's Conditions of Carriage, fare rules and ticket conditions.

15.3 Airline tickets are often subject to specific restrictions relating to:

  • cancellations;
  • refunds;
  • date changes;
  • route changes;
  • passenger name amendments;
  • baggage allowances;
  • seat selection;
  • meals;
  • check-in requirements.

15.4 Certain promotional or discounted airline tickets may be wholly non-refundable and non-changeable after ticket issuance.

15.5 We will advise you of any significant fare restrictions before your booking is confirmed wherever reasonably practicable.

15.6 Once an airline ticket has been issued, all amendments remain subject to the airline's rules and any applicable fare difference, airline penalty or supplier charge.


16. Financial Protection for Flight Bookings

16.1 AmberFly Travel Ltd acts as an authorised travel agent for ATOL holders in relation to eligible flight bookings.

16.2 Where your booking qualifies for protection under the Air Travel Organiser's Licence (ATOL) Scheme, the applicable ATOL holder will provide the financial protection for your booking in accordance with UK law.

16.3 Where required under the ATOL Scheme, an ATOL Certificate will be issued identifying the ATOL holder responsible for providing financial protection together with details of the protection applicable to your booking.

16.4 Your ATOL Certificate is an important document. You should read it carefully and retain it with your travel documents.

16.5 Further information regarding the ATOL Scheme is available from the UK Civil Aviation Authority.


17. Accommodation Bookings

17.1 AmberFly Travel Ltd arranges hotel and accommodation reservations through selected accommodation providers and global reservation systems.

17.2 Hotel descriptions, facilities, photographs, star ratings and customer reviews are supplied by accommodation providers and third-party reservation systems.

17.3 While every effort is made to ensure accuracy, AmberFly Travel Ltd cannot guarantee the accuracy of descriptions provided by third parties.

17.4 Hotel classifications and star ratings vary between countries and should be regarded as a general guide rather than a universal standard.

17.5 Requests such as:

  • adjoining rooms;
  • smoking or non-smoking rooms;
  • specific views;
  • early check-in;
  • late check-out;
  • accessible rooms;
  • particular floor levels;

are requests only and cannot be guaranteed unless confirmed in writing by the accommodation provider.

 

18. Accommodation Standards

18.1 Accommodation standards, facilities and services vary between countries, destinations and accommodation providers.

18.2 Hotel classifications, star ratings and descriptions are intended as a general guide only and may differ from UK standards.

18.3 AmberFly Travel Ltd accepts no responsibility where a customer's expectations differ from local accommodation standards or classifications.

18.4 Photographs, descriptions and facility information are supplied by accommodation providers or third-party reservation systems and are believed to be accurate at the time of publication.

18.5 Accommodation providers may alter facilities, services or amenities without prior notice, and such changes are outside the control of AmberFly Travel Ltd.

 


19. Special Accommodation Requests

19.1 Customers may request special accommodation arrangements at the time of booking, including room preferences, bedding configurations, adjoining rooms or accessibility requirements.

19.2 AmberFly Travel Ltd will communicate all reasonable requests to the relevant accommodation provider but cannot guarantee that such requests will be fulfilled unless confirmed in writing by the accommodation provider.

19.3 Special requests do not form part of the booking contract and failure to fulfil a request shall not constitute a breach of contract by AmberFly Travel Ltd or the accommodation provider.

19.4 Any additional charges arising from special accommodation requests shall be the responsibility of the customer unless otherwise agreed in writing.

19.5 AmberFly Travel Ltd accepts no liability where a requested accommodation preference is unavailable upon arrival.

 

20. Accommodation Changes

20.1 Occasionally accommodation providers may change room allocations, facilities or services for operational reasons.

20.2 Such changes are outside the control of AmberFly Travel Ltd.

20.3 Where we are notified of any significant change before departure, we will endeavour to inform you as soon as reasonably practicable.

 

21. Check-in Requirements

21.1 Customers are responsible for complying with the check-in requirements of the relevant airline.

21.2 Airlines may require online check-in, airport check-in or both.

21.3 Failure to check in within the airline's specified deadlines may result in denied boarding without refund.

21.4 AmberFly Travel Ltd recommends checking the airline's check-in requirements well before departure.


22. Baggage

22.1 Baggage allowances vary between airlines, routes and ticket types.

22.2 Customers are responsible for ensuring that they understand the baggage allowance applicable to their booking before travel.

22.3 Additional baggage charges imposed by airlines remain the responsibility of the customer.

22.4 AmberFly Travel Ltd accepts no responsibility for baggage fees charged directly by airlines.


23. Special Assistance

23.1 Customers requiring special assistance should notify AmberFly Travel Ltd at the earliest possible opportunity.

23.2 Requests for special assistance may include:

  • wheelchair assistance;
  • reduced mobility services;
  • medical assistance;
  • special seating requirements;
  • assistance for visually or hearing-impaired passengers.

23.3 Requests for assistance remain subject to airline or supplier approval and cannot be guaranteed unless confirmed by the relevant supplier.


24. Special Requests

24.1 Customers may request special arrangements including:

  • special meals;
  • adjoining rooms;
  • accessible accommodation;
  • specific room locations;
  • additional bedding;
  • infant cots.

24.2 AmberFly Travel Ltd will pass such requests to the relevant supplier but cannot guarantee fulfilment unless confirmed in writing by the supplier.


25. Travel Documents

25.1 Travel documents may include:

  • airline tickets;
  • hotel vouchers;
  • transfer vouchers;
  • cruise documentation;
  • travel itineraries;
  • visa documents (where applicable).

25.2 Customers should carefully check all travel documents immediately upon receipt.

25.3 Any discrepancies should be reported to AmberFly Travel Ltd without delay.


26. Changes Requested by the Customer

26.1 Any request to change a confirmed booking remains subject to:

  • supplier approval;
  • fare rules;
  • availability;
  • applicable amendment charges.

26.2 Airlines and suppliers may refuse requested changes depending upon the conditions applicable to the booking.

26.3 AmberFly Travel Ltd may charge an administration fee in addition to supplier amendment charges where permitted by law.


27. Changes by Suppliers

27.1 Airlines, hotels and other suppliers may occasionally change:

  • flight times;
  • aircraft type;
  • accommodation;
  • routes;
  • schedules;
  • facilities.

27.2 Such changes remain outside the control of AmberFly Travel Ltd.

27.3 Where we are notified of any significant change before departure, we will endeavor to inform you as soon as reasonably practicable. if we are informed by the supplier of any change to, or cancellation of, you’re booking If the supplier offers you alternative arrangements or a refund, we will communicate the options to you and give you a deadline to respond. If we do not receive your response within that timeframe, the supplier may reasonably assume that you accept the default option

 


28. Cancellations by the Customer

28.1 Cancellation requests should be submitted as soon as possible.

28.2 Cancellation charges will depend upon:

  • airline fare rules;
  • supplier conditions;
  • the date cancellation is received.

28.3 Certain bookings may be wholly non-refundable.

28.4 Any refundable amounts remain subject to supplier authorisation and processing.


29. Cancellations by Suppliers

29.1 Occasionally airlines or other suppliers may cancel travel services.

29.2 Where this occurs, your rights will depend upon the applicable supplier conditions and relevant legislation.

29.3 AmberFly Travel Ltd will provide reasonable assistance in communicating available options offered by the supplier.


30. Refunds

30.1 Refund eligibility depends upon the fare conditions and supplier booking terms applicable to your booking.

30.2 Where refunds are authorised by the supplier, processing times vary considerably and may take several weeks or longer.

30.3 AmberFly Travel Ltd cannot guarantee supplier refund processing times.

30.4 Any administration charges applied by AmberFly Travel Ltd may be deducted from any refund where permitted by law.

 

31. Missed Flights

31.1 Customers are responsible for arriving at the airport in sufficient time to complete:

  • check-in;
  • baggage drop;
  • security screening;
  • immigration procedures;
  • boarding.

31.2 Failure to arrive before airline check-in deadlines may result in denied boarding without refund.

31.3 AmberFly Travel Ltd cannot accept responsibility where travel is missed due to:

  • traffic delays;
  • public transport disruption;
  • incorrect travel documentation;
  • late arrival;
  • personal circumstances;

or any event beyond our reasonable control.


32. Connecting Flights

32.1 Where separate flight tickets are booked independently, each ticket constitutes a separate contract.

32.2 If a delay to one separately booked flight causes a missed onward flight, the second airline may treat the passenger as a no-show.

32.3 AmberFly Travel Ltd strongly recommends allowing sufficient connection time when travelling on separate tickets.

32.4 Customers choosing separate tickets do so at their own risk.


33. No-Show

If you fail to:

  • check in;
  • board your flight;
  • use any booked accommodation;
  • use any booked travel service;

without prior cancellation, the supplier may treat your booking as a "No Show."

Most suppliers do not provide refunds for unused services following a No Show.


34. Unused Services

No refund will normally be available for:

  • unused hotel nights;
  • missed transfers;
  • unused meals;
  • unused excursions;
  • missed flights;

or any other travel service not used voluntarily by the customer unless the supplier's conditions specifically allow otherwise.


35. Airline Rights

Airlines reserve the right to refuse carriage where passengers fail to comply with:

  • passport requirements;
  • visa requirements;
  • health requirements;
  • baggage rules;
  • behavioural standards;
  • safety instructions;

or any other applicable airline conditions.

AmberFly Travel Ltd accepts no liability for any costs arising from such refusal where it results from the passenger's failure to comply with applicable requirements.


36. Passports

36.1 Every traveller is responsible for ensuring that they hold a valid passport that meets the entry requirements of their destination country and any country through which they transit.

36.2 Unless a different validity period applies, many countries require passports to be valid for at least six (6) months beyond the date of arrival or intended departure. Entry requirements vary between countries and may change without notice.

36.3 It is your responsibility to verify the passport validity requirements applicable to your journey before confirming your booking and before travelling.

36.4 AmberFly Travel Ltd cannot accept responsibility if you are refused boarding or refused entry because your passport is invalid, damaged, expired or does not satisfy the entry requirements of the destination or transit country.


37. Visa Requirements

37.1 Each traveller is solely responsible for obtaining all required visas before travel.

This includes, where applicable:

  • Tourist Visas
  • Visitor Visas
  • Business Visas
  • Residence Visas
  • Transit Visas
  • Electronic Travel Authorisations (ETA)
  • Electronic Travel Authorisations (eTA)
  • Any other immigration permissions required for travel.

37.2 Visa requirements vary according to:

  • nationality;
  • passport held;
  • destination;
  • transit points;
  • length of stay;
  • purpose of travel.

37.3 Visa requirements may change at short notice. Customers should always verify the latest requirements with the relevant Embassy, High Commission, Consulate or Immigration Authority before travelling.

37.4 Where AmberFly Travel Ltd provides visa assistance, we act solely as an intermediary to assist with the application process. We do not make immigration decisions and cannot influence the outcome of any visa application.

37.5 AmberFly Travel Ltd accepts no responsibility for any financial loss arising from:

  • visa refusal;
  • delayed visa processing;
  • incomplete applications;
  • incorrect information supplied by the customer;
  • changes in immigration policies.

38. Health Requirements

38.1 Certain countries require travellers to satisfy health, vaccination or medical entry requirements before arrival.

These may include:

  • vaccination certificates;
  • medical declarations;
  • health screening;
  • infectious disease documentation;
  • other government health requirements.

38.2 It is the traveller's responsibility to ensure compliance with all health requirements applicable to the destination and any transit country.

38.3 AmberFly Travel Ltd recommends consulting your GP or a qualified travel health clinic well in advance of departure to obtain the latest medical advice relevant to your destination.


39. Government Travel Advice

39.1 Customers are strongly encouraged to review the latest travel advice issued by the UK Foreign, Commonwealth & Development Office (FCDO) before making travel arrangements and again before departure.

39.2 Government travel advice may include important information relating to:

  • safety;
  • security;
  • local laws;
  • entry requirements;
  • political unrest;
  • natural disasters;
  • health risks;
  • travel disruptions.

39.3 AmberFly Travel Ltd cannot accept responsibility for losses arising from a customer's failure to review or follow official travel advice.


40. Travel Insurance

40.1 AmberFly Travel Ltd strongly recommends that every traveller obtains comprehensive travel insurance immediately after booking.

40.2 Your travel insurance should provide suitable cover for, where appropriate:

  • cancellation;
  • curtailment;
  • medical expenses;
  • emergency repatriation;
  • personal accident;
  • baggage;
  • personal belongings;
  • travel delays;
  • missed departure;
  • legal expenses;
  • personal liability.

40.3 AmberFly Travel Ltd does not provide travel insurance and accepts no responsibility for any uninsured losses incurred during your journey.

41. Force Majeure

41.1 AmberFly Travel Ltd shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control.

41.2 Such events may include, but are not limited to:

  • war;
  • threat of war;
  • civil unrest;
  • terrorism;
  • industrial disputes;
  • strikes;
  • lockouts;
  • natural disasters;
  • floods;
  • earthquakes;
  • volcanic activity;
  • pandemics;
  • epidemics;
  • government action;
  • airport closures;
  • air traffic control restrictions;
  • adverse weather conditions;
  • fire;
  • mechanical failures;
  • or any other extraordinary circumstance beyond our reasonable control.

41.3 Where such circumstances occur, AmberFly Travel Ltd will use reasonable endeavours to assist customers, but accepts no liability for losses arising from circumstances beyond our control.


42. Limitation of Liability

42.1 AmberFly Travel Ltd acts primarily as a travel agent arranging travel services provided by third-party suppliers.

42.2 To the fullest extent permitted by law, AmberFly Travel Ltd shall not be liable for:

  • acts or omissions of airlines;
  • acts or omissions of hotels;
  • acts or omissions of tour operators;
  • acts or omissions of transfer providers;
  • acts or omissions of visa authorities;
  • acts or omissions of any other supplier.

42.3 Nothing within these Booking Terms & Conditions excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • any liability that cannot legally be excluded under English law.

43. Customer Liability

43.1 Customers remain responsible for any loss or damage caused by their own acts or omissions during travel.

43.2 Customers may be held personally liable by airlines, hotels or other suppliers for:

  • damage to property;
  • misconduct;
  • unlawful behaviour;
  • breach of supplier conditions.

43.3 AmberFly Travel Ltd accepts no liability for such losses.


44. Complaints

44.1 If you experience difficulties during your trip, you should report the matter immediately to the relevant supplier to allow an opportunity for the issue to be resolved.

44.2 If the issue remains unresolved, please notify AmberFly Travel Ltd as soon as reasonably practicable.

44.3 Formal complaints should be submitted in writing together with any supporting evidence.

44.4 AmberFly Travel Ltd will investigate complaints fairly and respond within a reasonable period.


45. Alternative Dispute Resolution

45.1 AmberFly Travel Ltd will endeavour to resolve customer complaints amicably wherever possible.

45.2 Nothing within these Booking Terms & Conditions prevents either party from exercising their legal rights.


46. Data Protection

46.1 AmberFly Travel Ltd processes personal information in accordance with applicable UK data protection legislation.

46.2 Personal information may be shared with airlines, hotels, visa providers, payment processors and other suppliers where necessary for the performance of your booking.

47. Website Use

47.1 Information published on the AmberFly Travel Ltd website is provided for general information only.

47.2 While reasonable efforts are made to ensure accuracy, AmberFly Travel Ltd cannot guarantee that website content will always be complete, current or error-free.

47.3 Prices, availability and travel information remain subject to change without notice.


48. Intellectual Property

48.1 All content appearing on the AmberFly Travel Ltd website, including text, graphics, logos, photographs and design, remains the property of AmberFly Travel Ltd or its licensors unless otherwise stated.

48.2 No content may be copied, reproduced or distributed without prior written permission except where permitted by law.


49. Severability

49.1 If any provision of these Booking Terms & Conditions is found to be unlawful, invalid or unenforceable, the remaining provisions shall remain in full force and effect.


50. Entire Agreement
